A city councillor who was allowed to keep his job after being found guilty of indecently assaulting three young women has resigned.
City of Belmont councillor Tamak Vijay was this week convicted of three counts of indecently touching the women in a car while he was overseeing their driving tests in February.
Earlier this week, the city said there were no grounds for his disqualification from council.
The Department of Local Government explained that was because he had not committed a serious local government offence or been convicted of an indictable offence which carried a penalty of more than five years in prison.
But on Thursday morning, the City of Belmont confirmed Vijay had quit his position as a councillor in a resignation email circulated last night.
"I strongly believe this is in the best interest of the city and its people," Vijay said in a quote from his email shared with the media by the city.
The city said it would replace Vijay with Jarod Harris, who was the runner up for the position at the 2023 local government elections.
The department said the decision to resign was up to Vijay and that it, nor the City of Belmont, held any power in deciding whether he remained in his role.
The ABC has contacted Vijay for comment.
In court on Monday, Magistrate Andrew Matthews found Vijay guilty of the assaults and fined him $6,000, describing the incidents as a "clear breach of trust".
Vijay had denied any physical contact with his students and did not give evidence during his trial.
In the first assault Vijay, who was sitting in the passenger seat of the car, squeezed the thigh of his victim as they undertook the driving tests in West Perth.
The second victim described Vijay as "touchy", and the magistrate said she was "steadfast" that he'd touched her at least three times without consent.
A third victim had only lived in Perth for six months when she too was touched by Vijay.
All three of the victims were born overseas.
Magistrate Matthews refused an application for a spent conviction, advising Vijay to "put this offending behind you" and to move on with his life as best as he could.
