A Franklin man who police allegedly caught in the middle of a drug deal told officers he had been just "having a smoke", but was unable to produce any cigarettes when questioned, a court has heard.
Benjamin Charles Dumbrell, 30, was sitting in the driver's seat of a car with its headlights on in the Gungahlin Lakes Club carpark when approached by police about 10.35pm on Sunday.
When officers searched the car, they allegedly found four grams of cocaine, 8.4 grams of methamphetamine and a Taser. They also found about $3000 in cash said to be the proceeds of a drug deal.
Mr Dumbrell appeared in the ACT Magistrates Court on Monday, when he applied for bail through a Legal Aid duty solicitor.
The solicitor told the court that Mr Dumbrell denied knowing about the drugs or Taser and had been shocked when police opened the door to reveal the weapon in the side pocket.
He said the car belonged to a friend and the cash was winnings from the pokies that night, for which he had receipts, she said. He had gone outside for a smoke, but got into the car because it was cold.
Police allegations tendered to the court suggest Mr Dumbrell was in the black BMW with another man when officers approached the car.
The officer: "What are you doing here?"
Mr Dumbrell: "Just having a smoke."
"But you aren't smoking, where are your smokes?"
"Um, I don't know"
"Why not just smoke in the smoking area of the club?"
"Um, because people drink in the club."
Mr Dumbrell was arrested on Sunday night and later searched at the police station, where police allegedly found drugs in his shoe, about 0.2 grams of a white crystalline substance suspected to be ice.
When questioned by Magistrate Robert Cook about these drugs, the solicitor said she had been instructed the drugs were for personal use.
Mr Dumbrell was formally refused bail. No pleas were entered.
He will appear in court at a later date.
