An upcoming pro-Palestinian rally and candle light vigil in Sydney could be prevented from going ahead, with NSW Police deciding to apply to the state's Supreme Court to prohibit both planned assemblies.

The demonstrations, scheduled for Sunday October 6 and on Monday October 7, have been organised by Palestine Action Group.

In a statement, NSW Police said it has "conducted negotiations with protest organisers, who did submit a Form 1 for each proposed public assembly".

However, despite the negotiations, NSW Police said it was not satisfied that "the protest can proceed safely" for those involved and the wider community.

NSW Police added that, while police recognise the right to free speech and peaceful assembly, its first priority is to keep the community safe.

"Accordingly, the commissioner has decided to apply to the NSW Supreme Court to prohibit the two assemblies."

The NSW police commissioner has no specific powers to stop a public assembly from occurring in the state.

Josh Lees from the Palestine Action Group said they weren't officially notified of the decision last night and were in talks with police over the location of the protest.

"As far as we were concerned, we were still in talks with them so we are kind of surprised to hear that out of the blue, they have announced this step.

"Of course if we need to, we will go to court to fight for our right to protest."

It's not yet known when a Supreme Court hearing might take place.

This long weekend marks the one year anniversary of the Hamas attack on Israel.

Israeli officials say more than 1,200 people were killed, thousands injured and hostages taken across the border to Gaza.

Since then, Gaza officials say more than 40,000 people have been killed and many more injured during the Israeli Gaza war.
