A driving assessor indecently touched young women as they were taking their licence tests, instructing one to park on a deserted street where he placed his hand on her thigh, a Perth court has been told.

Tamak Vijay, who is also a councillor at the City of Belmont, is defending three charges in the Perth Magistrates Court.

It is alleged the 39-year-old touched women on their left thigh during driving assessments in February.

One of the alleged victims told the court she had been asked by Mr Vijay to drive down an empty street before she was asked to park.

She told the court he placed his hand on her thigh close to her underwear and squeezed for five or six seconds.

The woman said he then put a finger to his lips in a "shushing" motion and showed her the tablet which was being used to record the test.

She told the court Mr Vijay then told her she failed to indicate when pulling over.

I had to keep 'playing cool'

The woman said she was "quite shocked" by the incident as nothing like that had happened to her before.

She testified that later in the test, Mr Vijay grabbed her shoulder when she was driving and rubbed her leg when she was parking.

She said she felt "disgusting" but had to keep "playing cool".

She told the court her mental health had been affected and she was in a "very bad state" after the test.

Mr Vijay's lawyer, Rachel Porter, put it to the woman that she was wrong about the order of events, and that the touching did not even happen.

The alleged victim rejected both assertions.

Ms Porter also questioned the woman's claim that she wanted to get away from Mr Vijay, because she had even offered him a job at one point.

She responded that she was trying to stay cool.

"A stranger was touching me all over my body, what do you want me to do?" she asked.

"It was messed up that day.

"I was in a state of shock."

The police prosecutor told the court the complainants were all born overseas.

He said it was the "same touch to all three women".

The prosecutor said Mr Vijay had put his finger to his lips, as in a "shush" motion, because the tests were being recorded.

Ms Porter argued the touching was not "inherently" indecent, and described her client as being an "overhelpful driving assessor".

She said any "shushing" action was in relation to driving activity, such as not using an indicator, or turning a certain way.

Driver compliance officer David Neal told the court Mr Vijay had worked with the Department of Transport since 2022 and there had been no disciplinary complaints.

Mr Neal said there was a policy of no physical contact between assessors and clients, except in an emergency, such as when they had to take the wheel or apply the handbrake.

The court was told all of the alleged victims passed their tests.

Mr Vijay is on a leave of absence from Belmont Council and it's understood he had his employment with the transport department terminated earlier this year.
